Two iPod users who sued Apple have been given the boot out of the courtroom. Back in 2006, a pathetic and misguided duo sued Apple because they claimed the max volume possible on the iPod of 115dB could damage the hearing of the user. While I could stomach the reason for the lawsuit, what was hysterical was the demand. The two sought to be compensated for the amount they overpaid for the iPod. There are two problems with that kind of demand. 1) How much is considered overpaying? 2) Nobody held the proverbial gun to their head. They accepted the monetary demands from Apple and made the purchase with free will. Judge James Ware dismissed the frivolous lawsuit, claiming that no evidence was providing regarding actual damage to user hearing. Doesn’t surprise me that this lawsuit actually took place however. We are after all dealing with America, which has long up held the motto of ‘when in doubt, sue.’
